A member of staff at a care home has admitted unlawfully assaulting one of the residents.

Philip Maguire, of Crossan Road, Trillick, appeared at Fermanagh Court and was conditionally discharged for two years.

A prosecutor explained that around 8.30pm on July 23, Maguire was at the Mantlin House residential facility in Kesh. He was a member of staff but was off-duty at the time. He had a medical condition and was supposed to be taking medication. One of the male residents was shouting at staff. Maguire grabbed the resident and pushed his hand up against his throat with his forearm. He later told police: "I made a swing at him and grabbed hold of him to shake him up." The prosecutor said Maguire told police he hadn't been taking his medication and hadn't intended to hurt the resident.

The court heard that Maguire no longer works at the facility.

District Judge Liam McNally told him it was unfortunate that at the age of 52 he had blemished his clear record.

He said the assault was against the "background where there was some provocation from the injured party, who was obviously behaving badly towards the staff".
