A 28-YEAR-OLD man who shouted abuse at police officers after he had earlier been thrown out of a flat in Enniskillen has been fined £200.

Lee Anthony Michael Carty, of Drumbawn Close, Drumclay, Enniskillen, was charged with using disorderly behaviour in a public place, namely Derrin Road, on July 20, 2016.

Carty entered a guilty plea when he appeared before Fermanagh Magistrates Court on Monday.

The court heard that, at 3am, police were tasked to Derrin Road after receiving a report of a disturbance and an ongoing fight.

Upon arrival, they observed the defendant, who had been ejected from a flat in the area. He shouted abuse and acted aggressively towards the officers.

When he was placed in the rear of the police vehicle, Carty continued to shout abuse and banged his head off the window.

The defendant was subsequently taken into custody and charged to attend court.

Defending solicitor, Emer Cox, told the court that her client was “deeply embarrassed” and remorseful about the incident, adding that he wanted to apologise to both the police and the local residents.

In mitigation, the solicitor said that it had been three years since the defendant had previously been involved with the police.

She urged the judge to give her client credit for his early guilty plea and the gap in his offending.

District judge Peter King observed that the defendant had been fined £200 in 2013 for using disorderly behaviour.

The judge noted that Carty had then received a community service order in 2014, but that this had subsequently been revoked and replaced with a suspended sentence.

However, Mr King acknowledged that the defendant’s latest offence had occurred towards the end of the suspended sentence and said he was not going to make an order in connection with that.

Given the gap in offending, the judge imposed a £200 fine and a £15 offender levy on the defendant.
