The trial of a 54-year-old grandfather, charged with causing the death of 48-year-old motorcyclist Brian Lynch by driving carelessly on the main A4 road between Lisbellaw and Tamlaght on November 15, 2014, has been aborted at Dungannon Crown Court today (Thursday).

The trial was aborted because the jury could not reach a verdict in the case.

During the hearing on Tuesday, Joseph Keenan from Lawnakilla Park, Enniskillen told police that he does not recall looking over his shoulder “at any stage” before pulling out to overtake a car and colliding with Mr. Lynch’s motorbike.

Prosecution QC Charles MacCreanor contended that the collision occurred “as soon as” Keenan moved out to overtake. He told Keenan: “If you had glanced over your shoulder to your right, this collision wouldn’t have occurred.”

Keenan, a football manager, said the collision occurred when he was coming towards the end of his overtaking manoeuvre. He said he “didn’t see” Mr. Lynch in his car mirrors and “got the shock of his life” when he realised the motorbike was “wobbling” beside his car.

“My own version was, [Mr. Lynch] was coming too hard and had two choices: to run into the back of me or to come down the side of me,” Keenan told the court.

The case is listed for mention at Dungannon Crown Court on Tuesday, May 2.
