Man sitting in van in lay-by was over the limit

A 59-year-old man found sitting in a van parked side-by-side with another vehicle in a lay-by had been drinking, Fermanagh Court has heard.

Eugene Mary Joseph MacCaul, of Drumboghanagh, Newtownbutler, was fined £100 and banned from driving for four months when he admitted being in charge of a vehicle after consuming excess alcohol.

A prosecutor told the court that at 2.15am on December 13, last year, police saw two vehicles parked side-by-side in a lay-by at Leggykelly on the Cavan Road, Netownbutler. As they approached the lay-by one of the vehicles took off at speed. MacCaul was sitting in the second vehicle with the keys in the ignition and the engine running. There was a smell of intoxicating liquor from him and a sample of his breath produced an alcohol reading of 60 - 25 in excess of the legal limit.
