A DISORDERLY man who kicked out at police after he was arrested in Enniskillen in the early hours of the morning has been fined £200.

Joseph Dolan (27), of Cornacully Road, Belcoo, pleaded guilty to using disorderly behaviour in a public place, namely Killynure Green, Enniskillen, and assaulting a police officer on July 27, 2017.

Fermanagh Magistrates Court heard that, at 3.20am, police dealing with a separate matter in Enniskillen had cause to speak to the defendant.

While he was being escorted to a police vehicle, Dolan kicked out twice.

The defendant, who was intoxicated, was acting aggressively and shouting and swearing.

As he continued to struggle, police had to apply limb restraints.

Defending counsel, Ciaran Roddy, told the court that, on the night in question, his client had been combining alcohol with mental health medication.

He claimed that this had a “drastic effect” on his mood.

In mitigation, the barrister said that Dolan had entered guilty pleas at the first opportunity.

District judge, Nigel Broderick, gave the defendant credit for his clear record and early guilty pleas.

The judge said he would impose a fine on this occasion, but warned Dolan that if he repeated the behaviour it would not be a fine the next time.

Mr. Broderick imposed fines totalling £200 and ordered the defendant to pay a £15 offender levy.
