A woman who was found driving a car with a range of defects has been issued with penalty points and a fine at Fermanagh Magistrates Court.

The court heard that on September 15, 2018 police were carrying out a joint operation with the Driver Vehicle Agency (DVA) on modified vehicles on the Enniskillen area.

The defendant, Delia Brazil (27) with an address of Foxhill Close, Enniskillen was driving a white Ford Sierra on the Irvinestown Road in the town when she was detected and the car was brought to the vehicle test centre for a full inspection.

The prosecution read out a lengthy list of defects found on the car including defective tyres, exhaust, braking system, a loose battery and excessive exhaust emission to which District Judge Michael Ranaghan asked jokingly: “was the sunroof working?”

The car issued with a prohibition notice and the driver was cautioned.

Brazil’s solicitor, Gary Smyth, told the court that when examined by the trained eye these defects could be picked out but his client was not trained to see this.

He said the car had been disposed off and that his client was embarrassed to be in this situation.

Brazil was found guilty of using a motor vehicle in a dangerous condition and having no vehicle test certificate.

Judge Ranaghan took into account her early plea along with no previous conditions and the fact the car had been disposed off and issued three penalty points and a £150 to Brazil.
