A woman, already in custody on “more serious charges” was handed a six-month prison sentence at Fermanagh Magistrates Court this week for common assault where the court heard she had kicked a man while he was on the ground.

33-year-old Karen McDonald of McCrea Park Clogher appeared via video link from Hydebank prison and pleaded guilty to the charge.

The court heard that police had been called to an incident at a garage on Queen Street in Enniskillen.

It was revealed that another party, who also faces charges resulting from the incident, was being restrained on the ground by a member of the public.

The prosecution explained that McDonald had kicked the prone member of the public in the head and that CCTV received after the event had clearly illustrated this point.

Defence Barrister Stephen Fitzpatrick said that the defence accepted that due to the nature of the incident the “court will be taking it very seriously” however he also said that it “was not a prolonged attack” and that it had been a “single blow”. He also said that CCTV had shown that she had in “no way been the instigator” of the incident.

District Judge Michael Ranaghan who said he was “all too familiar” with the defendant’s record, handed down a six month prison sentence and activated one of two suspended sentences, with a further two month sentence imposed.
