A 38-year-old man who allegedly attacked his ex-wife and her partner has been refused bail at Fermanagh Magistrates Court.

District Judge Michael Ranaghan felt Arek Nowicki, of Church Street, Enniskillen would be liable to commit further offences and interfere with witnesses and injured parties following the incident which took place on June 8, 2019 in which he is charged with burglary with intent to commit GBH and threats to kill..

A police officer outlined for the court that on the day in question, police received a 999 call with a report of an ongoing domestic incident at Hillview Road, Enniskillen.

It was reported that the defendant had attended the address and gained unlawful entry to the property and assaulted his ex-wife and her partner.

Police attended and spoke to both alleged victims. They informed police that Nowicki had gained access through a window and entered without permission.

The partner alleged he was thrown on a bed and punched 25 to 30 times while Nowicki's ex-wife said she was forced out of the way and pushed to the ground.

Officer noted the injuries of both alleged victims.

The partner also said the defendant had made threats to kill which he believed.

Officers located and arrested the defendant.

The officer in court objected to bail being granted due to fear of interference with witnesses and given the seriousness of the charges and possibility of reoffending.

The court heard that Nowicki worked in the same company as his ex-wife's partner and that there were also previous domestic incident in 2017.

Gary Black, representing Nowicki, pointed out that there had been no concerns raised about the injured party and his client coming into contact in their place of work along with there being no medical treatment availed of and no weapon used in the incident.

Mr. Black said the particular charges were very serious but there were significant evidential issues around them and that they could be changed to common assault.

Judge Ranaghan said it was a serious incident and although he appreciated with all Mr. Black had to say in regards to the evidential difficulties he did not view the defendant as a suitbale candidate for bail.

Nowicki was remanded in custody at Maghabery Prision and the case was adjourned until July 8.
