A Fivemiletown man caught without insurance for the sixth time, had just taken delivery of a new vehicle when police came on the scene. 

Jason Albert Birney (32) of Main Street was detected without insurance on July 18, 2019. 

The court heard police on patrol in the Riverview area of Augher carried out a database check of a Vauxhall Corsa and found it had no insurance.  

Birney was standing at the vehicle and on being spoken to advised it had just been delivered to him and admitted there was no insurance in place. 

A defence solicitor told Dungannon Magistrates Court it was conceded there is a previous relevant record but, “The penny has dropped.” 

He also referred to the date of the incident noting, “It is fast approaching the two year anniversary, which is unfortunate.” 

It was confirmed the car had indeed just been delivered and as a result of detection was seized and has not been returned, causing financial loss. 

Addressing Birney directly, District Judge Michael Ranaghan said: “This is your sixth no insurance and there’s no getting away from that. The custody threshold is passed. However your defence say you have now matured and while I can’t take your word for that, I can take his.” 

A Combination Order was imposed consisting of one year on Probation and 60 hours Community Service. 

Driving was also disqualified for 10 months.
