A MAN who had fallen out with his brother before being arrested by police in Irvinestown has been convicted of several public order offences.

Paul Adrian Timlin (40), of Sprucehill, Irvinestown, was convicted of disorderly behaviour, resisting police and assault on police.

On July 7, police were called to an incident in Forthill Park in the town, where the defendant's brother lived. It was reported the defendant had shown up and demanded to fight, but his brother did not go out.

Later on, at around 1.20am on Pound Street, Timlin was spotted by police, who he told to "f*** off" and approached them with his fists clenched. He was arrested but began to struggle when they attempted to handcuff him.

He continued to shout and swear, and threatened to kill them "stone dead".

Tommy Owens, representing Timlin, told the court the dispute between the brothers had been sorted out.

He said that when Timlin had been stopped by police he had consumed a large amount of alcohol and felt somewhat aggrieved for being stopped.

Mr. Owens said Timlin had "overreacted" and it was "totally out of character" for him, adding that he apologised to the officers when he got to the police station and he wanted to do so again in court.

He also asked the court to give him credit for his early plea.

Deputy District Judge Greg McCourt warned Timlin that he will be in more serious trouble if he comes back before the courts again, before fining him £350.
