Fermanagh and Omagh District Council has successfully taken a prosecution against a County Tyrone-based company for health and safety failings.

The family-run company, which has its premises in Beragh, pleaded guilty on January 18 at Omagh Magistrates Court to two health and safety offences.

The prosecution followed a Council investigation into an accident which took place in the car park of Cooley Castles Ltd. in January, 2018.

Environmental Health officers from the Council’s Environmental Health service investigated the accident and found that a mother and daughter had been walking across the car park towards the entrance of a play shed building when they fell six feet into a vehicle inspection pit.

The woman suffered a fracture of the arm and the child suffered minor injuries.

The investigation found that protective measures in place to prevent people from falling into the inspection pit were inadequate, and that the responsible person failed to notify the enforcing authority about the accident.

Commenting on the case, a spokesperson for Fermanagh and Omagh District Council said: “The Council gives a high priority to the investigation of offences under Health and Safety legislation.

"Accidents are investigated thoroughly and, where necessary, formal action is taken, such as prosecution for offences as in this case.”
