A five-month prison sentence has been given to a man convicted of breaching a restraining order.
On June 14, police received a report from a member of the public who said they observed William Thomas Birney (56), of Spout Gardens, Fivemiletown, breaching his restraining order by being within 100 metres of a house at Hillview Road, Enniskillen.
Police spoke with the female occupant of the house, who said Birney was not there and had not been in the house.
As they were leaving, a male told police they had observed Birney leaving through the back door of the house and into the house next door.
Arrested
Police spoke to those in the house next door, who allowed them into the property, and they located Birney who was then arrested.
The defendant did not comment during the interview with the police, Enniskillen Magistrates Court heard on Monday.
Stephen Fitzpatrick, a barrister for Birney, said the defendant was very familiar with the court.
He said Birney instructed him that the woman the restraining order related to had contacted him and invited him to the house.
He added that this female did not make the complaint about Birney, but that this was not an excuse.
Giving Birney credit for his guilty plea, District Judge Keown handed him a five-month sentence.
