A man who attempted to avoid a police speed checkpoint by pulling in and entering a shop had no valid driving licence or insurance, a court has heard.

On July 15, police were conducting a speed check operation on Cornagrade Road, Enniskillen opposite Rooney's off-licence and in the direction of Cherrymount.

Enniskillen Magistrates Court heard on Monday that officers noticed a Peugeot 308 turning into the car park that they believed was attempting to avoid them.

The driver of the car – Aleksjes Jevsejevs (38), with an address of Killadeas Road, Enniskillen – entered the shop and police carried out checks on the car.

The insurance policy in place was in the name of a male, but the police did not believe it was Jevsejevs.

When Jevsejevs returned to the car, police spoke with him about their enquiries, and detected a smell of alcohol. He subsequently failed a preliminary breath test.

He was arrested for driving with excess alcohol and for having no insurance or driving licence, to which he said: "Am I under arrest?"

Once in police custody, Jevsejevs refused to provide an evidential sample of breath.

On July 16, police viewed CCTV footage that showed Jevsejevs driving the car.

Jevsejevs' solicitor, Gary Black, told the court the car had been purchased a matter of days before the incident and was still insured to the previous owner, but this cover did not extend to Jevsejevs.

Mr. Black also handed in an insurance policy which was taken out by Jevsejevs days after he was stopped.

Concerning the driving licence, Mr. Black said Jevsejevs lost his licence in 2012 and had to resit his driving test, which he had not done.

But, Mr. Black said, the most significant charge Jevsejevs faced was the failure to provide a specimen, and said there was no reason why he should not have.

For having no driving licence or insurance and failing to provide a specimen Jevsejevs was disqualified for two years and fined £550.
