On Monday, Enniskillen Magistrates Court heard that on September 24, at 2.15am police responded to a dropped 999 call from an address at Hillview Road, Enniskillen.

When they arrived at the property, they spoke with the injured party, who informed them that William Thomas Birney (56), of no fixed abode, was inside the house.

A police officer told the court they were objecting to bail as there was a likelihood of reoffending, with Birney breaching bail conditions seven times.

The officer confirmed there had been no statement made by the injured party, and there were no other allegations arising from Birney being at the property.

His solicitor, Garry Smyth, said Birney had instructed him and made the case during the interview that he was invited to the house by the injured party, but acknowledged that he should not have been there.

He pointed out there were no further allegations made, but admitted Birney had a relevant record, and this was a recurring theme.

District Judge Steven Keown refused bail, saying this is a well-known path with Birney, who should be all too aware to abide by the warning from the court to stay away from a vulnerable person.

Birney was remanded in custody to appear again on October 24.
