An Enniskillen man who is facing six charges including two of common assault has had his bail application to be allowed to return to his home refused.

Derek McDowell (53), of Tempo Road, Enniskillen is facing two charges of criminal damage, and one charge each of assault occasioning actual bodily harm and attempted grievous bodily harm with intent alongside the two charges of common assault.

They relate to an incident on August 26, 2021.

A police officer told the court they could connect the accused to the six charges.

The defendant, who is currently residing away from the home he shares with his partner, had a bail application made on his behalf by his solicitor, Gary Black to allow him to return to his home.

The police officer said the report of the incident was made by ambulance personnel who attended a domestic incident where the injured party presented with a reddened face, blurred vision and was soaking wet.

She alleged she had been soaked with a hose before petrol and bleach was poured on her.

The injured party made a statement but this was withdrawn while McDowell was in custody with the victim wanting to rekindle her relationship with the defendant.

The officer told the court these were serious allegations against McDowell and there were concerns it could happen again as the victim told police this was an ongoing problem but this incident was the first time it was reported to police.

Under questioning from Mr. Black, the officer, confirmed McDowell had no criminal record and had denied the offences.

He also said that because the victim had withdrew her statement there was unlikely that he would interfere with witnesses.

It was also heard that the defendant, while not allowed in the house, had been travelling to his business which is adjacent to the house.

Mr. Black added that this case would take some time before concluding and that because of the victim’s withdrawal statement it was likely to proceed on the evidence from bodyworn footage.

District Judge Steven Keown refused the application to allow McDowell to return to the house describing it as “premature” as the case was in its early stages.

The case was adjourned for McDowell to appear on November 1.
