A man who breached a restraining order prohibiting him from contacting a woman and being within 100 metres of her home has been remanded in custody.

William Thomas Birney (56), of Tullyreagh Road, Tempo, was at a property on Hillview Road on January 15.

Police were tasked to the address after reports of a domestic incident, and when they arrived at 7.36pm they observed Birney standing outside the house.

Officers made him aware of the restraining order, and that he was not to be within 100 metres of the address, before arresting him for the breach.

At Omagh Police Station, Birney made full admissions about the breach.

A police officer told Enniskillen Magistrates Court on Monday that they were objecting to Birney being released on bail as they believed there would be further offending.

They pointed out Birney's restraining order had only been issued on January 5, but had been breached in 10 days.

They said there was a "substantial domestic history" between the parties from 2012 onwards, with numerous breaches, and there was a likelihood the injured party and defendant would make contact with each other.

In applying for bail for Birney, his barrister, Stephen Fitzpatrick, accepted it was a difficult application to make.

He said Birney had a "lamentable record" but pointed out this restraining order was the first one to have no contact with the other party, despite objections that it would result in what has transpired.

However, District Judge Steven Keown told Mr. Fitzpatrick it was a "hopeless application", due to Birney's behaviour, and bail was refused.

The case was adjourned until February 14.
