A man who breached his Probation order had the order revoked and has been resentenced to one month in prison.

Ryan James Birney (28), of Main Street, Maguiresbridge, appeared in the dock at Enniskillen Magistrates Court on Monday to hear his fate following three breaches of Probation following his conviction in February, 2021.

His solicitor, Garry Smyth, told the court that his client had completed previous Probation orders, which he was entitled to some credit for, before adding Birney acknowledged there was a breakdown with Probation which led to the current situation.

The court heard that last September, Birney behaved inappropriately to a female client at Probation, and when this was addressed he became angry and irate, making "libellous allegations".

Briney's behaviour was such that his appointment had to be rescheduled.

It was also heard that a family member intervened and "muddied the waters" of the situation.

Mr. Smyth said Birney was alive to the jeopardy he finds himself, in adding that while the order was not completed, some of it was, which was to his credit.

He said the defendant was taking steps to address issues around substance misuse, and he had not come to police attention of late.

However, District Judge Steven Keown told Birney he was given the chance to engage with the hard-pressed Probation service to avoid custody, and he had "behaved outrageously" towards them.

Birney's Probation order was revoked by Judge Keown, who sentenced him to one month in prison; however, he was released on bail pending appeal.
