An Enniskillen man has been disqualified from driving after he was found asleep in a car by an off-duty police officer.

On February 6, the off-duty officer was travelling to Kesh Police Station at around 6.40am when he observed a vehicle on the side of the Killadeas Road, Kesh.

The officer approached the Ford Fiesta where there was a male, Rhys Cunningham (21), of Corban Avenue, Enniskillen, in the driver's seat, and the engine was running.

Cunningham was lying back and appeared to be unconscious, but when the officer touched his shoulder he woke up.

There was a smell of alcohol, so the officer arranged for another officer to attend and carry out a preliminary breath test, which Cunningham subsequently failed.

He was arrested and taken to Omagh Police Station where he produced an evidential reading of 89mg of alcohol in 100ml of breath.

He was further arrested of being in charge with excess alcohol and having no insurance.

The defendant told police the owner of the car had given him permission to drive the vehicle.

Michael Fahy, solicitor for the defendant, accepted the reading was somewhat high, but said Cunningham had met the matter fairly and expeditiously.

He said the defendant thought he had third party insurance on the car, but this was not the case due to his age.

Mr. Fahy said he was advised by Cunningham that on the day in question his phone had run out of power, and he had nobody to ring to come and collect him, and that was why he was found in the car.

For being in charge with excess alcohol and using a vehicle without insurance, Cunningham was disqualified from driving for 12 months, and also fined £550.
