A man who urinated in an Enniskillen takeaway before damaging the plexiglass Covid-19 shield in place has been given a community service order.

Police were tasked to the Kebab Hut on Darling Street, at 11pm on November 20 following reports that a man had urinated on the floor and was refusing to leave.

Before police arrived the reporting party had called again to say they man, Eamon Blaise Oliver Gallagher (47), of Loane Drive, Enniskillen, had smashed the plexiglass Covid shield in the takeaway.

When police arrived they saw a male in a red t-shirt and a puddle on the floor. The man was unsteady on his feet, his breath smelt of alcohol, his eyes were glazed and he speech was slurred. There was also a strong smell of urine.

Gallagher was taken outside and arrested. He was interviewed the next day and gave a no comment interview. Gallagher’s barrister, Ciaran Roddy, described what happened as an “extremely unsavoury incident” and that his client’s liberty was at stake due a previous suspended sentence that he already had over him.

Mr. Roddy said Gallagher was “extremely intoxicated” but said this was not a mitigating factor but was to provide context.

He said Gallagher cuts “a more pleasant prospect in sobriety” and there was a significant degree of remorse from the defendant, borne out in the pre-sentence report.

This, Mr. Roddy said, was shown in Gallagher bringing £100 to court to give as compensation to the injured party. Mr. Roddy said that Gallagher was a suitable candidate for probation or community services and had accepted culpability at a very early stage.

He added that since the incident Gallagher had abstained from alcohol

Deputy District Judge John Rea decided not to activate the suspended sentence but ordered Gallagher to complete 120 hours of community service and pay £100 in compensation.
