A drink-driver who was caught using a mobile phone whilst driving also had no insurance or driving licence, a court has heard.

On April 11, at around 6.20pm police on mobile patrol in Enniskillen observed a man using his mobile phone whilst driving a Ford Transit van.

They followed the man – Eugene Thomas Toye (57), of Grogey road, Altmartin, Brookeborough – onto the Castle Coole Road whilst he was still using the phone.

Enniskillen Magistrates Court further heard on Monday that officers signalled for the vehicle to stop, and when they spoke to Toye, they detected a smell of alcohol and he subsequently failed a preliminary breath test.

He had no current licence, and was arrested for driving with excess alcohol, having no driving licence or insurance, and using a mobile phone whilst driving.

The court heard Toye was cautioned and made no reply, and further heard that in police custody, an evidential reading of 48mg of alcohol in 100ml of breath was given by Toye.

Ronan McCourt, solicitor for Toye, told the court that his client had not got his licence back from a previous offence, and without it had no insurance.

He said the reading was relatively low, but he was not trying to justify the offence, and pointed out that Toye had co-operated fully with police.

For driving with excess alcohol, having no driving licence or insurance, and using a mobile phone whilst driving, Toye was disqualified from driving for three years and fined a total of £700.
