A Kesh man has been handed a £200 fine for driving without due care and attention.
Enniskillen Magistrates Court heard on the Monday the case against Gavin Campbell (37) of Rosscolban Meadows, Kesh who was charged with driving without due care and attention on the Ballydoolagh Road, Enniskillen.
The court heard some of the damage sustained by a second vehicle as it pulled in to avoid Campbell during the incident on the Ballydoolagh Road which occurred at 10.30am on the morning of August 29.
Deputy District Judge Brian Archer queried if Campbell was on the wrong side of the road. Campbell’s solicitor, Mr. Michael Fahy challenged this and said: “This is a country road bereft of markings, there is no wrong side or right side of road on this particular road. He [Campbell] swerved and he didn’t stop. There was no contact between the vehicles.”
The solicitor also asked for credit be given to the defendant for pleading guilty in the first instance.
Deputy District Judge said: “Three points and you will stay on the road, if there is anything else then you will be off the road."
The judge handed Mr. Campbell three penalty point and ordered him to pay a fine of £200 as well as an offender levy of £15.
