An Enniskillen man has been refused bail after he breached his bail conditions and a restraining order.

Philip Kenneth Moore (52), of Oakfield Court, Enniskillen was out on bail concerning charges of harassment (2), domestic abuse offence (2), disclosing private sexual photographs (3) and persistent improper use of communications about incidents between March 4 and April 4, 2022.

One of the conditions was not to contact the alleged injured party, while there was also a restraining order in place. However, it was heard that at 10.30pm on October 15, the injured party reported she had received seven calls on October 14 which she believed to be from the defendant, Enniskillen Magistrates Court heard on Monday.

There were also three more calls on October 16, one of which lasted for 42 minutes. In this call, the injured party said she recognised Moore’s voice. She said the calls had left her “frightened and anxious”.

Police then attended to the defendant’s house to arrest him for breaching the restraining order. While getting dressed Moore lifted a pair of woman’s underwear and threw them at police. When he went into the hallway he shoved past another officer, elbowing him and shouting aggressively. He was further arrested for two counts of assault on police. Police objected to Moore being released on bail due to the possibility of further offending and interfering with witnesses.

Ciaran Roddy, a barrister for Moore, told the court his client accepted the breach of bail but said there was an ongoing relationship between the parties. He said Moore wanted to apologise to the officers he assaulted, adding that remanding Moore in custody could harm his mental health and the current probation order he is completing.

District Judge Steven Keown agreed that Moore needed help, but also that the injured party needed protection. He denied bail, saying Moore had no intention of abiding by any conditions. Moore is due to appear again on October 31 via video link.
