AN ENNISKILLEN man who refused to comply with a police breath test had gone "off the rails", a court has heard.
Oliver Dineen (42) of Ashbourne Manor, Enniskillen, was sentenced at Enniskillen Magistrate's Court on Monday, March 4.
The court heard how previous charges of dangerous driving and drink-driving had been withdrawn.
A prosecutor told the court how on January 19, 2023, police received a report that a silver Volkswagen Transporter had "mounted the kerb several times" in Enniskillen.
Police located the van parked at the Queen Elizabeth Road, Enniskillen.
There they spoke with Dineen, noting a strong smell of alcohol and that his response to police questions was "slow".
He refused to carry out a preliminary breath test and was then arrested.
In custody, Dineen denied that he was driving the van at the time of the incident.
Dineen's solicitor said that when the incident had occurred, Dineen had "went off the rails for a period".
The solicitor added that Dineen was a trained electrician who had started a new job just this week.
District judge Alana McSorley disqualified Dineen from driving for a total of 12-months, and imposed a £300 and £15 offender levy.
