A 50-YEAR-OLD man was three times over the legal drink driving limit when he urinated in full view of the public at a petrol station forecourt on a Sunday lunchtime, Fermanagh Magistrates Court has heard.

George McAndrews, of Blackrock Park, Belleek, pleaded guilty to driving with excess alcohol on his breath and using indecent behaviour at Topaz Filling Station, Shore Road, Enniskillen on October 15, 2017.

The court heard that, at 12.55pm, plain-clothed police officers in an unmarked vehicle observed the defendant urinating against a wall at the garage forecourt.

He was unsteady on his feet, his speech was slurred and his eyes were glazed.

After detecting the smell of intoxicating liquor, McAndrews was asked to take a preliminary breath test, which returned a positive result.

He was conveyed to Enniskillen police station, where an evidential breath test returned a reading of 114 micrograms of alcohol in 100ml of breath – over three times in excess of the legal limit.

During interview, he was shown CCTV footage of him entering the filling station's shop to pay for fuel.

Defending solicitor, Niall Bogue, told the court that there was “no getting around” the high reading in the case.

He said that his client struggled with alcoholism and also used prescription medication for long-term health difficulties.

The solicitor said that McAndrews regretted his actions on the morning in question, which he attributed to the effect of alcohol and prescription medication.

After deputy district judge Paul Conway observed that he presumed a filling station would have toilets on the premises, Mr. Bogue replied that his client's decision-making had been “impaired” on that morning.

Describing his behaviour as “reprehensible”, the judge told the court that McAndrews had been driving on a Sunday lunchtime while he was three times over the limit.

Mr. Conway also said that the defendant had been urinating in full view of the public at a time of day when children would be present.

The judge imposed fines totalling £350, a £15 offender levy and disqualified him from driving for 12 months.
