Two men accused of raping and sexually abusing a woman with a mental disorder were remanded in custody when they appeared in the dock of Fermanagh Court on Monday.

A 49-year-old man of no fixed abode is charged with raping the woman on April 14, to April 15, 2015.

He is further charged that between the same dates he engaged her in a sexual act, knowing that by reason of her mental disorder “she was likely to be unable to refuse”.

His co-accused, a 42-year-old man with an address in Fermanagh, is charged with raping the woman on April 14, to April 15, 2015.

He is further charged that between the same dates he sexually assaulted the woman.

A detective constable told the court that he was the investigating officer in the case and believed he could connect both men with the charges.

Defence solicitor Michael Fahy, representing the 42-year-old man, ask if the police interviews had been completed.

The detective said the interviews were due to take place in the next week.

Mr. Fahy said his client would be applying for bail next Monday.

In reply to questions from defence solicitor Garry Smyth, representing the 49-year-old man, the detective confirmed that the 49-year-old man had given an account to police and denied any offences.

The officer also confirmed that the offences were allegedly committed last Tuesday night or Wednesday morning and that a complaint was not made to the police until Saturday evening.

District Judge Nigel Broderick pointed out that the complainant was entitled to automatic anonymity and made a reporting restriction prohibiting publication of any details pertaining to her identification.

Prosecution and defence lawyers both argued for a reporting restriction on the names of the defendants to prevent the identification of the woman.

The District Judge said the risk of a “jigsaw” identification of the woman was a matter for the media. He remanded the two men in custody to appear again at Fermanagh Court by video link from Maghaberry Prison on Monday, April 27.
